Breaking: Max Hardcore Too Hardcore For FloridaFollowing 14 hours of deliberation today, a Tampa jury found extreme pornographer Max Hardcore guilty on ten counts of distributing obscene material, the first time Hardcore has been found guilty in a career full of obscenity legislation. Hardcore said that he would appeal, and is free on bail until a September 5 sentencing. “I’m full of good spirits and they didn’t get my house,” Hardcore told AVN.

Hardcore’s attorneys told jurors that no one could have purchased or seen the eight hours of fisting, urination, and mock-”underage” footage by mistake, and (according to AVN), several jurors approached the Hardcore team afterward and expressed sympathy, saying the poor wording of the legislation painted them in a corner.

Despite past successful defenses for more extreme material than the likes of “Fists of Fury 4″ and “Extreme Max 19,” as well as the positive testimony of retired porn star Summer Luv—who told the jury that Hardcore, unlike other porn directors, “cared” and paid on time—the jury was unable to sidestep existing law, which counts as obscene anything that “appeals to prurient interest.”

As a precedent, this case bodes ill for Evil Angel and director John Stagliano, who face similar charges for tamer movies. That case is not expected to go to trial until next year.

    Every loss at an obscenity case is a travesty. On the other hand, the absolute last person I’d want to be standing next to during an obscenity trial is Max Hardcore.

    This is bad….really, really BAD! What consenting adult do to each other sexually, or what they watch other consenting adult do sexually should not be up for some closeted pervert prosecutors, judges or juries to decide.
    Is this becoming a totalitarian state?!
    The real obscenity is the persecution from the self-righteous butt-plugs who seek to impose their narrow minded will on everyone else.

    I really wouldn’t mind seeing total anarchy in the street over this censorship shit. Burn the fucking bible belt and all the government officials that have nothing better to do than to fuck over the free will of adults.

    @Tracer_Bullet: I wouldn’t want to be prosecuted alongside someone’s fictional porn persona, either. Unfortunately, Paul Little was the one on trial, though the prosecution constantly referred to his creation and he as one and the same. I keep trying to pass myself off as Huckleberry Hound in real life, but all this blue makeup is beginning to give me a nasty rash that’s starting to resemble Snagglepuss.

    @bdve: The questionable legality of the hosted servers being located in Florida was irrelevant to the trial (as were the clips, especially as the jury sat through whole dvds worth of material anyway). Seems like the courts had learned from the high-wire act that was the JM/FiveStar case a few years ago, hence the emphasis on the outright “prurient” nature that brought the case to a close.

    @indiepixels: Adult entertainment is more of an easy target in this day and age, as the few with the resources and willingness to defend those in trouble are less likely to do so due to the taboo nature of being on the viewing end of the spectrum. Even if my grandmother endorses masturbation in an open court, how many people would be willing to believe her, or even understand, her right to watch Golden Apples In the Cum or Nellie’s Sesame Factory VII? She’s 88 and lives in the Carolinas.

    I am assuming that many have a god complex. It is by this self-appointed divine nature they can judge the sexual behavior and or sexual beliefs of others. It isn’t by divine appointment that anyone should doubt that an adult has the right to believe and practice masturbation, sodomy,or whatever if the person says it is so.
    When I say burn the bible belt I don’t literally mean burning Texas, Oaklahoma, etc. I mean torching the sick mentally that subscribes to sitting in holier than thou judgment of others based on a book of myths and symbolisms.
    Max Hardcore is extreme to the point of being ridiculous at times, but it is consenting adults having sex, no matter how strange and perhaps distasteful to some it maybe, they have the right to do so. Max Hardcore and anyone else should have the right to create and distribute to adults this material.
    What’s next the sexual thought police? What, is getting a boner while watching chick in a short skirt cross the street a crime? Was her presence obscene? Was it her intent to appeal to my purient interest?
    Again the obscenity lies in the minds of the sexually repressed self-righteous, not those who refuse to live by the false “moral” standard of an anally retentive society.
    You know it’s the chick with the big black vibrating dildo hidden in the closet and the guy with the gay gang bang dvds hidden in his tool shed that sit in judgment of us pornographers. Isn’t it really fucking ironic?!

    @indiepixels: The most ironic part of the whole situation is that sex will outlive us all as long as there’s still people inhabiting the planet far enough in the future to enjoy it (I keep my fire-proof escape pod stocked with enough lotions and stroke books, just in case), or that even the term “fucking” is just a variation on “making love”. This is a mean old world, after all, but it doesn’t have to be!
