The ruling in Miller v. California as quoted in that article is such a blatant misuse of the actual Supreme Court precedent that I want to scream. While the ruling in Miller was a rather conservative ruling it held that obscenity was based upon the contemporary community standards test. It is up to each state and even more to the point each individual community to deem what is obscene and what is not. I give you the 2 Live Crew fiasco in Florida in the late 80′s. I realize I am preaching to the choir on this one but it still irks me to no end. You have to wonder when these people will stop using fear tactics to get there way.
